Western Union® Gold Card Programme Agreement (Effective December 2009).
Important Information for Participants in the Western Union Gold Card Programme

This Western Union Gold Card Programme Agreement ("Agreement") contains the terms and conditions governing the Western Union Gold Card Programme ("Programme"). The terms "Western Union" "we" "us" and "our" used in this Agreement mean Western Union Payment Services Ireland Limited, an Irish registered company with number 471360, based at Richview Office Park, Unit 9, Clonskeagh, Dublin 14, Ireland. "You" and "your" means the person to whom a Western Union Gold Card ("Card") is issued pursuant to this Agreement. "Participating Agent" and "Participating Agent location" means respectively a Western Union® Agent and any of their locations that participates in the Programme. You may obtain a list of Participating Agents by contacting us as set forth in Section 10.

1. This is your Contract with us.

You should read this Agreement and keep it for your records. By enrolling, using the Card or by otherwise participating in the Programme, you agree to the terms of this Agreement. Your Card is required to perform any Programme transactions. Your Card remains the property of Western Union and must be returned to us immediately upon our request in case of abuse, cancellation of this Agreement or ending of the Programme. To benefit from all its advantages your Card can only be used by you. Its use is subject to the terms of this Agreement. The Card is personal to you and cannot be shared.

2. Description of the Programme.

  • A. Convenience: The Programme allows you to request completion of a Western Union® Money TransferSM transaction at Participating Agent locations ("Qualifying Transaction") more conveniently. The Programme allows you to provide information about yourself each time you send or receive money via a Qualifying Transaction, which we will store electronically by means of a database, which will be managed by Western Union so that it will be available automatically at Participating Agent locations whenever you present your Card. The list of Participating Agent locations can be obtained by contacting the Western Union Gold Card Programme Customer Service Centre on 80075791 (free call from fixed and public phones. Tariffs for mobile calls are set by your operator), or by contacting Western Union in writing, as set forth in Section 10 below. All money transfers that you initiate using the Programme are subject to the terms and conditions set out in this Agreement, as well as the terms and conditions applicable to Qualifying Transactions initiated at Participating Agent locations where you send/receive the money transfer (these terms and conditions appear on the "To Send Money" and "To Receive Money" forms available from Participating Agent locations). In order to use the Card and participate in the Programme, you must fulfill all requirements pursuant to law, to enable you to send/receive money transfers in a particular country.
  • B. Rewards: The Programme enables you to earn points if you pay a transfer fee to send money for each Qualifying Transaction sent from Participating Agent locations ("Points"), as described herein. The required amount of the transaction for each point can be found in the Welcome Pack enclosed with these terms and conditions. In order to qualify for Points, you must: i) present your Card at the beginning of each Qualifying Transaction; ii) complete a fee paying Qualifying Transaction at a Participating Agent location; iii) if required by local laws, present current identification which bears the same name as the one you have provided for the Programme (and any other information required by the Participating Agent location); and iv) satisfy all other requirements of the Programme. Your Points will be added to your Card at the time each Qualifying Transaction is completed. Points are not earned when you receive money transfers. The current amount of the Points on your Card is available on request by contacting Western Union as set forth below under Section 10.

3. Participation in the Programme.

The Programme is open to private individuals who are 18 years and older and have a main residence at a valid address in the Sultanate of Oman. Only one application per person will be accepted. We may, in our discretion and always according to the legal imperatives in force, refuse to accept your application if you do not satisfy our application criteria.

4. Obtaining Points for Transactions without Your Card.

If you carried out a Qualifying Transaction but did not use your Card, you may still acquire points by contacting us at the number provided in Section 10 below. Western Union reserves the right not to issue Points if it cannot verify the transaction.

5. Redeeming your Points.

Once you accumulate the requisite number of Points for the available rewards, you may redeem your Points by either logging onto www.westernuniongold.com or by contacting us at the number provided in Section 10 below. The rewards and required number of Points to redeem such rewards are subject to change at Western Union’s sole discretion and without notice. Any rewards other than discounts are subject to availability. A certain minimum number of points may be required to redeem rewards. Points are not negotiable, transferrable or redeemable for cash. Points can only be redeemed and used for sent transactions made in the Sultanate of Oman. Information about the required Points to redeem as well as the rewards can be obtained by contacting the Western Union Gold Card Programme as set forth below under Section 10.

6. Rewards and Benefits.

All rewards and benefits offered are subject to change and availability or cancellation without any prior notice from us, while local restrictions and alterations may apply. Any substitute rewards will be of a similar or greater quality and value to those offered.

7. Important Information about your Points.

Points expire two years from date of the Qualifying Transaction. Any Points earned on your Card will be forfeited when your Card is cancelled, closed, revoked, found to be fraudulent or declared void under law. Points are not considered earned until actually redeemed by you and do not constitute a credit balance to your account or your Card. Points have no cash value and will not earn interest and are not insured against loss. Points can not be purchased, sold, combined or transferred in any way. Maintaining the Card and the Points are your sole responsibility. Rewards will not be replaced if lost or stolen nor will Points used to redeem such rewards be reaccredited to your account.

8. Data Protection.

Your personal information is processed under the applicable laws. Your personal information is controlled by Western Union (whose detailed data is provided at the outset of this document). Western Union uses personal data ("Information") provided in the money transfer instruction, together with other information which is collected or generated during the course of your relationship with Western Union, such as transaction and loyalty program details, transaction history and marketing preferences, for the purposes of providing you with the requested services (including, among others, for purposes such as administration, customer service, user validation, fraud prevention and product and business development activities). Western Union may also use Information in connection with other services, products, convenience and/or rewards programs, you signed up for with Western Union or its affiliates. Western Union will hold and retain information that the sender gives us about another person such as the details of the receiver of the money transfer service (the "Third Party’s Information") in order to execute the transaction. The provision of Information and the Third Party’s Information is voluntary but necessary (subject to the provisions set out in this paragraph) to execute the transaction. Without the relevant information, Western Union is unable to execute the money transfer, facilitate convenience activities or other requested services. Western Union will use the name and address provided above to send you commercial communications by post. Also in accordance with your marketing preferences, by choosing to enter details in the optional fields, Western Union or its affiliates and business partners may send commercial communications regarding Western Unions products and services by phone/email/SMS/MMS to the sender. By agreeing to receive communications by phone/SMS/MMS, the sender accepts that any charges imposed on the sender by the network provider for this service are the sender’s sole responsibility. If you do not wish to receive such communications, please contact West Union in the manner indicated below. We will disclose Your Information and Your Third Party Information (together the "Information") to third parties located outside the Sultanate of Oman, with whom we have a contractual relationship to protect Information such as authorized service providers, Agents and other third parties as reasonably required for the purposes indicated in these Terms and Conditions, and to carry out the money transfer or to facilitate future transactions, or to supplement Information with information from publicly available sources, such as information to validate the accuracy of your address. This also helps Western Union to understand and improve our product and service offerings. Western Union may also disclose Information to third parties, where reasonably necessary, for the purposes of the prevention and detection of crime, prosecution of offenders, for purposes of national security or when required by law. Western Union retains Information, the marketing preferences and transaction history of the sender based on our record retention schedules for no longer than is necessary for the purposes for which the data were collected and in compliance with applicable laws. If the sender does not perform another transaction within the retention time period, the Sender Information as well as all marketing preferences will be cancelled.
You consent to the Information being transferred to countries outside of the Sultanate of Oman, including the EEA and/or the United States, but not exclusively, whose privacy laws may be less stringent. The Information will be transferred for the purposes indicated in these Terms and Conditions and to enable Western Union to provide the money transfer service and additional services, products and loyalty or convenience programs and also for internal purposes, such as administering the customer relationship, marketing purposes, compliance with legal requirements, research and customer analytics. The categories of data transferred are personally identifiable information, contact details and information relating to the money transfer, transaction history, and any other Information supplied by you. This data may be accessed by Western Union affiliates, as defined by applicable law, including Western Union Payment Services Ireland Ltd, Western Union Payment Services UK Limited, Western Union International Limited, and Western Union Financial Services, Inc, MT Payment Services Operations EU/EEA Ltd, MT International Operations Limited, WU Payment Services Network EU/EEA Ltd, for any of the purposes set out in these Terms and Conditions.

9. Our Liability to You.

The Card is a mere facility ancillary to the money transfer service provided by Western Union, its group companies and affiliates. To the greatest extent permitted by law, the total liability of Western Union, its group companies and affiliates to you for all damages, losses and causes of action under the Programme and/or this Agreement and/or in relation to the use of your Card shall not exceed US$500.00 or the equivalent in local currency. To the greatest extent permitted by law, Western Union, group companies and affiliates shall not be liable to you whatsoever for any indirect, special, incidental, or consequential damages, losses or liabilities, including any damages, losses or liabilities in connection with your money transfer transactions (which shall be governed by the then applicable Qualifying Transaction terms and conditions). Western Union shall not be responsible or liable for any products which are provided by a third party supplier, the provision of which shall be subject to that supplier’s terms and conditions, and all conditions and warranties whether express or implied and whether arising under legislation or otherwise, as to the condition, suitability, quality, fitness or safety of any rewards or benefits supplied under the Programme are expressly excluded to the full extent permitted by the law.

10. Contacting Western Union.

You may contact Western Union: to withdraw from the Programme, to report a lost or stolen Card, to request a replacement Card. You have a right to access and to ask for a copy of your Information for which Western Union may charge a small sum to the extent permitted by applicable law. You may also correct, erase or block Information which is incomplete, inaccurate or out-of-date. You may also object at any time on legitimate grounds relating to your particular situation to the processing of your Information, where the processing is not required to complete the service, by a law or regulation. If you wish to exercise these rights or no longer wish to receive commercial communications from Western Union. 11. Dormancy.

If you do not use your Card for a period of one year, we may suspend your participation in the Programme without notice to you.

12. Assignment.

Notwithstanding any other provision in this Agreement, you may not assign or transfer this Agreement or your Card or allow others to use your Card. You will be responsible for any unauthorized use of your Card unless and until you report it lost or stolen to Western Union by contacting us under Section 10. Western Union may freely assign this Agreement to group companies as part of a commercial restructuring.

13. Governing Law.

This Agreement and the relationship between Western Union and you shall be exclusively governed by, and interpreted in accordance with Irish law. Any dispute, controversy or claim arising out of or relating to this Agreement, or the breach thereof, shall be determined by arbitration administered by the International Centre for Dispute Resolution in accordance with its International Arbitration Rules. The number of arbitrators shall be one. The place of arbitration shall be Dublin, Ireland. The language of the arbitration shall be English. This Section 13 shall be deemed to be an arbitration agreement pursuant to Royal Decree 47/97 as amended promulgatinig the Law of Arbitration in Civil and Commercial Disputes in the Sultanate of Oman.

14. Provisions Severability.

If any provision of this Agreement is held to be invalid or unenforceable, the remainder of this Agreement will not be affected.

15. Amendment.

We may, from time to time, amend the terms of this Agreement without prior written notice to you, should objective commercial considerations require. The modified terms of this Agreement can be obtained by contacting Western Union as set forth above under Section 10. By initiating a Western Union® Money TransferSM transaction or by receiving a money transfer using your Card after this Agreement is amended or changed, you will be agreeing to any such amendment or change. Should you not accept any modifications to this Agreement, you must either (a) notify Western Union in writing within 15 days of the occurrence of such change, such notice giving rise to the termination of this Agreement or (b) terminate use of your Card.

16. Cancellation.

We may cancel the Programme, this Agreement or your entitlement to participate in the Programme immediately and without notice to you. You may cancel this Agreement at any time by notifying Western Union in writing. If you do this, your participation in the Programme will terminate within thirty (30) days after we receive your written request to cancel. Cancelling this Agreement will not affect your obligations under this Agreement to the extent that such obligations are capable of surviving the termination of this Agreement.

17. Terms and Conditions Modifications.

Western Union terms and conditions for sending money may vary from time to time. The updated terms and conditions for the Western Union Money Transfer service are on the money send forms, and for automated customer receipts, they are generally available on the back of the receipt. They are also available at the points of sale on request.
